Undoubtedly, a fair number of citizens feel that we have transcended the need for God to provide a context for a civil society. The “living tree” doctrine refers to a method of constitutional interpretation that allows for Canada’s Constitution to change and evolve while still acknowledging its original intentions The doctrine achieves a balance between two seemingly contradictory goals: predictability (the rule of law) and flexibility.
In the Biblical account of the Burning Bush as told in the book of Exodus, there are three main elements – the bush, God’s presence, and fire. Inwardly, the bush hosts God’s presence without being overtaken by the intensity of His transcendent Being. Outwardly, the fire burns the bush but is not consumed. The bush maintains its identity as a “bush” without being disintegrated by the inward and outward forces.
The preamble to Canada’s modern Constitution Act, 1982 states “Whereas Canada is founded upon principles that recognize the supremacy of God and the rule of law.” God is also referenced in Canada’s official name which is the “Dominion of Canada”. The term “Dominion” and Canada’s motto: “A Mari usque ad Mari” both reference Psalm 72:8 – “And He shall dominion from sea to sea”.
The burning bush pattern was not limited to events in the Bible. The poison oak remedy provides a simple example of symbolism. Poison oak is a small, climbing vine, native to North America, with leaves that turn orange, deep red, and purple in the fall. Visually, it can look like a burning bush. But many react allergically to its toxic oil. Skin reactions ranging from small itchy red dots to puss-filled boils, blisters, and swelling glands. Poison oak is practically a bush that inflames the body with a burning intensity.
The remedy against poison oak’s toxins – aboriginals used a homeopathic remedy. They ate the first budding leaves in Spring. Their bodies became accustomed to the toxins and built a resistance to further exposure throughout the rest of the year.
They protect themselves against the fire (poison oak toxins) by voluntarily bring into their body a part of that fire. The ‘indwelling presence of the fire’ protected them from the fire without.
They are exposed but unburned. Conforming without relinquishing.
