Administrative & Regulatory Law

Administrative and regulatory bodies include tribunals, agencies, boards, commissions, self-governing professions, municipalities, and health and educational institutions. Despite living in a highly regulated society, the Canadian regulatory scheme is often cited as one of the most advance and fairest available. Most administrative and regulatory agencies have a high degree of specialization and clients generally have a right to fairness. Yet rules can be highly specific and can vary significantly. Regulatory offences, while not criminal, can include similar penalties without the requirement to prove ‘Mens rea’ or criminal intent.  

 
 

Human Rights Code

Under the Human Rights Code, businesses, employers, landlords and others are required to provide accommodations so that their services are fully accessible to everyone. Yet many recent decisions of the Human Rights Tribunal expand the definition and extent to which a party must provide code-based accommodations. Undue hardship has become untenable for many.

Residential Landlord &Tenancy law in Ontario (Residential Tenancies Act or RTA) is consumer legislation – written to protect tenants from the natural imbalance of power that stems from the fact that the landlord’s interest is almost invariably financially motivated, whereas the tenant’s interest is essential for shelter and security.

Self-representing as a landlord while possible may give credence to the adage penny wise and pound foolish. One misstep can set you back to the beginning after months of waiting.

Conversely, self-representing as a tenant may be the only option available if you are cash-strapped and up against the wall.
